1. DEFINITIONS

The expression "online sales contract" means the sales contract relating to material movable goods of the partner company of homainfully.com, stipulated between these and the Buyer in the context of a distance selling system through telematic tools, organized by the Provider.

The expression "Buyer" means the natural person consumer who makes the purchase, referred to in this contract, for purposes not related to any commercial or professional activity possibly carried out.

The expression "homainfully.com" means the subject that performs the promotion of the sale of goods that are the subject of this contract.

The expression "PARTNER COMPANY" means the subject that performs the sale of goods that are the subject of this contract.

2. IDENTIFICATION AND OBLIGATIONS OF THE PARTIES

Provider

The goods subject to these general conditions are put up for sale by the PARTNER COMPANY of homainfully.com, which is only responsible for the advertising promotion of the goods in question but not for the sale between the parties.

Buyer

Expressly declares to make the purchase for purposes unrelated to the commercial or professional activity carried out and undertakes not to trade what has been purchased.

3. OBJECT AND CONCLUSION OF THE CONTRACT

With this contract, respectively, the PARTNER COMPANY of homainfully.com sells and the Buyer purchases at a distance through telematic tools only the material movable goods indicated and offered for sale on this site or through our official sales channels.

The contract between the PARTNER COMPANY of homainfully.com and the buyer is concluded exclusively through the internet by accessing this site, where, following the indicated procedures, the Buyer will formalize the proposal for the purchase of the goods offered for sale.

The purchase contract is concluded and perfected through an irrevocable order by the Buyer with the completion and online sending of the order form, which will be displayed on the printable order summary web page, which shows the details of the orderer and the order, the price of the purchased goods and shipping costs, payment methods and terms, and the address where the goods will be delivered.

When the PARTNER COMPANY of homainfully.com receives the order from the Buyer, it will send a confirmation email and/or display a printable order confirmation and summary web page, which also shows the data entered by the buyer in the order form.

4. PAYMENT METHODS AND REFUNDS

The PARTNER COMPANY of homainfully.com accepts the following payment methods for purchased products:

• Cash on delivery
• Bank transfer
• PayPal payment
• Credit card payment

Credit card data is managed directly by banks specialized in managing online payments; PayPal data is managed directly by PayPal. The PARTNER COMPANY of homainfully.com reserves the right to request verification from the issuing bank of the genuineness of the card ownership or from PayPal in case of problems.

Any refund to the Buyer, if entitled, will be credited by reversing the payment with credit card, bank transfer, or PayPal, at most within 30 days from the date on which the PARTNER COMPANY of homainfully.com became aware of the cause that generates the right to the refund.

5. DELIVERY TIMES AND METHODS

The PARTNER COMPANY of homainfully.com will deliver the ordered products through agreed couriers. Products are shipped with appropriate packaging. If the packaging arrives torn or damaged, please verify the integrity of the product and immediately report the damage to the PARTNER COMPANY of homainfully.com staff.

Order processing times may vary from the same day of the order to a maximum of 40 working days, within which the product will be delivered. If the PARTNER COMPANY of homainfully.com is unable to make the shipment within this term, prompt notice will be given via email to the Buyer, indicating the term within which the order will be processed.

Delivery times may vary depending on the destination country and other factors not directly controllable by the Provider and not attributable to it.

6. SHIPPING AND DELIVERY COSTS

The delivery of products within the National Territory will take place without having to pay additional sums compared to what was already agreed upon when placing the order. For all other countries, the courier may present a separate invoice requesting payment of duties and taxes required by local authorities.

Buyers residing in a country that is not part of the EU are advised to inquire about local taxes and duties before placing an order with the Provider.

7. PRICES

All sale prices of products displayed and indicated within this website are expressed in euros (€) and constitute an offer to the public pursuant to art. 1336 of the Civil Code. Prices are inclusive of VAT and any other tax regarding delivery within the Italian national territory.

For deliveries to EU and non-EU countries, as specified in point 6), the courier may request additional amounts from the Buyer for local taxes and duties.

8. PRODUCT AVAILABILITY

The PARTNER COMPANY of homainfully.com ensures through the telematic system used the processing and fulfillment of orders without delay. Should an order exceed the existing quantity in the warehouse, the PARTNER COMPANY of homainfully.com will notify the Buyer via email whether the item is no longer bookable or what the waiting times are to obtain the chosen item, asking whether they intend to confirm the order or not.

The Provider's computer system confirms the order registration as soon as possible by sending the user a confirmation by email, which produces no legal obligation, being a simple order summary.

9. LIMITATION OF LIABILITY

The PARTNER COMPANY of homainfully.com assumes no responsibility for disruptions attributable to force majeure, in case it fails to execute the order within the times provided by the contract.

The PARTNER COMPANY of homainfully.com cannot be held responsible towards the Buyer, except in cases of fraud or gross negligence, for disruptions or malfunctions connected to the use of the internet outside its own control or that of its sub-suppliers.

The PARTNER COMPANY of homainfully.com will not be responsible for damages, losses, and costs suffered by the Buyer following non-performance of the contract for causes not attributable to it, with the Buyer having the right only to the full refund of the price paid.

The PARTNER COMPANY of homainfully.com assumes no responsibility for any fraudulent and illicit use that may be made by third parties of credit cards when paying for purchased products, provided it demonstrates having adopted all the ordinary precautions possible at the time and based on ordinary diligence.

10. LIABILITY FOR DEFECTS AND SELLER'S OBLIGATIONS

No compensation will be due when the injured party was aware of the product defect and the danger arising from it and nonetheless voluntarily exposed themselves to it. In any case, the injured party must prove the defect, the damage, and the causal connection between defect and damage.

The injured party may claim compensation for damages caused by death or personal injury or by destruction or deterioration of property other than the defective product, provided it is normally intended for private use or consumption and mainly used as such by the injured party.

The PARTNER COMPANY of homainfully.com assumes no responsibility for disruptions attributable to force majeure such as accidents, explosions, fires, strikes and/or lockouts, earthquakes, floods, and other similar events that prevent, in whole or in part, the execution of the sales agreement within the agreed times.

11. BUYER'S OBLIGATIONS

The Buyer undertakes to pay the price of the purchased goods within the times and methods indicated by the Contract. The Buyer undertakes, once the online purchase procedure is completed, to print and store the web page showing the order data.

The information contained in this contract has already been viewed and accepted by the Buyer, who acknowledges this, as at the time of order finalization a reference to this web page is shown.

12. RIGHT OF WITHDRAWAL

The CUSTOMER has the right to withdraw from the distance contract stipulated, without any penalty and without specifying the reason, by promptly communicating the cancellation within 10 days from the order placed via email to the seller's address info@homainfully.com before receiving confirmation as previously provided, or before the goods have been shipped.

If delivery of the goods has already taken place, the right of withdrawal is exercised by sending, within 10 working days from the day of receipt of the goods, a registered letter with return receipt to the SELLER's headquarters address.

Withdrawal Requirements

Such communication must contain:

• Data necessary to exactly identify the order
• Clear intention to renounce the purchase
• The product(s) for which the right of withdrawal is intended to be exercised
• Products must not have been used in any way
• Products must be returned with original intact packaging
• Copy of the relevant fiscal document (Invoice or Transport Document)

Return Process

The CUSTOMER is required to return the goods within ten days from the date of receipt. In this case, the only expenses due by the consumer for exercising the right of withdrawal are the direct expenses of returning the goods to the sender.

The SELLER undertakes to refund the CUSTOMER as soon as possible the amounts paid by them as payment of the price, deducting shipping costs of €25 and in any case within thirty days from the date when, having become aware of the exercise of the right of withdrawal by the CUSTOMER, receives the ordered goods, intact, at the address agreed with the PARTNER COMPANY of homainfully.com.

13. EXCHANGE OF GOODS

The PARTNER COMPANY of homainfully.com also grants the Buyer the option to exchange goods always within the same article. To obtain the exchange of goods, the Buyer is required to send an email to info@homainfully.com within 10 (ten) working days from the day of receipt with indications of the code of the article(s) to be exchanged, indicating the replacement goods.

Once the request is received, the Customer Assistance Office of the PARTNER COMPANY of homainfully.com will send the Buyer a written confirmation containing the goods exchange authorization number. The Buyer must indicate this authorization number on the label applied to the package of products to be returned.

In any case, transport costs for the exchange are borne by the Buyer. The PARTNER COMPANY of homainfully.com will not bear the costs necessary to send the product requested in exchange.

14. PRIVACY PROTECTION AND BUYER DATA PROCESSING

homainfully.com protects the privacy of its Buyers and guarantees that data processing complies with privacy regulations. Personal and fiscal data acquired directly and/or through third parties by the Provider data controller are collected and processed in paper, computer, and telematic form, in relation to processing methods for the purpose of registering the order and activating procedures for the execution of this contract and related necessary communications.

homainfully.com undertakes to treat with confidentiality the data and information transmitted by the Buyer and not to reveal them to unauthorized persons, nor to use them for purposes other than those for which they were collected or to transmit them to third parties. Such data may be exhibited only upon request of the judicial authority or other authorities authorized by law.

Your Data Rights

The Buyer enjoys the rights to obtain:

• Update, rectification, or integration of data when interested
• Deletion, transformation into anonymous form, or blocking of data processed in violation of law
• Attestation that the above operations have been brought to the knowledge of those to whom the data has been communicated or disseminated
• Opposition to data processing for legitimate reasons
• Opposition to processing for advertising, direct sales, market research, or commercial communication purposes

15. COMMUNICATIONS AND COMPLAINTS

Pursuant to applicable regulations, homainfully.com informs the Buyer that every order sent is stored in digital form on the server where the site resides according to criteria of confidentiality and security.

Written communications addressed to the Provider and any complaints will be considered valid only when sent to the address indicated in the contact section below.

16. CONTRACT ARCHIVING METHODS

The Buyer indicates in the registration form their residence and domicile, telephone number, or email address to which they want the Provider's communications to be sent.

17. DURATION AND EFFECTIVENESS OF CONTRACTUAL CONDITIONS

Order confirmation implies the Buyer's acceptance of these general conditions. These conditions may be updated or modified directly by transcribing the new rule on this site. The modification or update will be valid and effective for orders that have not yet been entered and for which the web page summarizing the order data has not yet been displayed and printed.
